Can the Nominated Individual take over when the Registered Manager of a care agency leaves?

Like most things, it all depends on additional detail. If a registered manager leaves then they need to cancel (deregister) their registration with CQC.

A new prospective manager will need to go through the registration process for a registered manager. It makes no difference who this is as their application is for a different role, so they will need to satisfy the criteria of the registered manager with CQC.

If the nominated individual does apply for the role and they have the necessary skills, knowledge, and competencies, it would be a good idea to appoint a new nominated individual, although this is not absolutely necessary – the roles are separate, and it is good practice wherever possible to have a separate nominated individual and registered manager.

Details of the process for the application of registered manager can be found here.

Guidance on what the legislation requires of an registered manager can be found here.
