If a person is injured in a care provider’s premises, what are the legal obligations of the care provider towards that person?
The Health and Safety Executive have published a guidance document specifically about Health and Safety in a Care Setting:
Health and safety in care homes HSG220
You can find this guidance document at http://www.hse.gov.uk/pUbns/priced/hsg220.pdf
This is a comprehensive guide to Health and Safety in a care setting and is sensitive to the fact that care homes are the individual service user’s own home.
The guidance specifically refers to visitors and your responsibilities and your responsibilities for instance at 2.3.
My advice to you would be to download this guidance document (if you haven’t done that already) and to work through the guidance to make sure that your Health and Safety Policies and Procedures meet the most up to date requirements.
With best wishes.
