Hi, I’m thinking about putting CCTV in the communal area in my home.This would safeguard both residents and staff alike. Do I need to ask permission from residents, staff and relatives? Thanks, Debbie

Dear Debbie,

Thank you for your question. I often think that it is an additional security feature in a care home to have CCTV in the communal areas and particularly near the stairs.

The simple answer to your question is no BUT that would be very poor practice.

CQC guidance on this matter states:

“The decision whether to use surveillance is for care providers to make in consultation with the people who use their services, and with families, carers, trade unions and staff. This document does not give guidance on whether or not you should use surveillance systems, and CQC does not require providers to do so.”

The guidance goes on to say:

“The legal framework requires that any use of surveillance in care services must be lawful, fair and proportionate – and used for purposes that support the delivery of safe, effective, compassionate and high-quality care.”

I believe that you should record the views of everyone that you consult about this matter and then taking into account their views, make your decision and record why you made the decision.

You will, of course, have to have policies in place about this. If you have Quality Compliance System’s (QCS) system then all the policies and procedures that you require will be available to you in the system.

I must stress that my advice only refers to the use of CCTV in communal areas.
